Please read these Terms and Conditions (“Terms”) carefully before using the Novalux Psychiatry website, online booking system, or patient portal (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
These Terms govern your use of our website and administrative tools. They do not replace the informed consent, treatment consent, and other clinical consent forms you sign as part of your care, which remain separately binding.
1.
Who May Use the Services
The Services are intended for individuals seeking or receiving psychiatric care from Novalux Psychiatry who are located in a state where our providers are licensed to practice. You must be at least 18 years old to create an account, or be the parent/legal guardian of a minor patient acting on their behalf, unless otherwise permitted under applicable law.
2.
Not for Emergency Use
Novalux Psychiatry does not provide emergency or crisis services. If you are experiencing a mental health emergency, thoughts of harming yourself or others, or any life-threatening situation, do not use this website or the patient portal to seek help. Instead:
- Call or text 988 (Suicide & Crisis Lifeline), or
- Call 911, or
- Go to your nearest emergency room.
Messages sent through the patient portal are not monitored in real time and should never be used to report an emergency.
3.
Nature of Services; No Guarantee of Outcome
Novalux Psychiatry provides psychiatric evaluation, medication management, and related behavioral health services, including via telehealth where clinically appropriate. Telehealth has both benefits and limitations compared to in-person care, and is not appropriate for every condition or situation; your provider will discuss this with you as part of clinical consent. We make no guarantee regarding specific treatment outcomes. Nothing on our website constitutes medical advice; it is for general informational purposes only and does not substitute for individualized evaluation by a licensed provider.
4.
Account Registration and Security
To access the patient portal, you must register and maintain accurate, current information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us promptly of any unauthorized use of your account
We may suspend or terminate portal access if we suspect fraudulent, abusive, or unauthorized use.
5.
Appointment Scheduling, Intake, and Consent
- Appointments may be scheduled by our administrative staff or through the online booking widget on our website.
- New patients, and returning patients with an upcoming appointment for which forms are outstanding, must complete and electronically sign required intake and consent forms through the patient portal before receiving full portal access or being seen for a visit.
- Electronic signatures on these forms are legally binding and are maintained with a tamper-evident record consistent with the U.S. ESIGN Act and applicable state law (e.g., UETA).
- Selecting insurance as your payment method authorizes us to run an eligibility check with your carrier prior to confirming your appointment.
6.
Fees, Billing, and Payment Authorization
- Payment method on file. A valid payment card must be kept on file to schedule and attend appointments.
- Copay/self-pay charges. For attended appointments, your card on file will be automatically charged at the end of the session — the applicable copay amount for insurance patients, or the posted self-pay rate for cash-pay patients.
- Cancellation policy. Appointments may be cancelled or rescheduled at no charge if you notify us at least 24 hours before your scheduled appointment time.
- No-show / late cancellation fee. If you fail to attend a scheduled appointment, or cancel with less than 24 hours’ notice, a separate no-show fee will be charged to your card on file.
- Insurance. You are responsible for confirming your coverage and for any amounts your insurance does not cover, including deductibles, copays, and coinsurance. Fee amounts are set by the clinic and may be updated from time to time; the fee in effect at the time of your visit will apply.
- By providing a payment card, you authorize Novalux Psychiatry to charge that card for copays, self-pay fees, and no-show fees as described above.
7.
Patient Portal Use
The patient portal is provided to help you manage appointments, complete required forms, and securely message your care team. You agree not to:
- Use the portal for emergency communications (see Section 2)
- Share your login credentials with anyone else
- Attempt to access another patient’s information or any non-public area of our systems
- Use the portal for any unlawful purpose, or to transmit harmful code
Portal messaging is monitored during business hours and is not a substitute for scheduled visits when clinically indicated.
8.
AI-Assisted Documentation
Where used, our AI-assisted clinical documentation tool requires your separate informed consent, described in our clinical consent forms and Privacy Policy. Your provider reviews and finalizes all AI-generated draft notes before they become part of your medical record. You may decline this feature at any time without it affecting your access to care.
9.
Intellectual Property
All content on our website — including text, graphics, logos, and software — is owned by or licensed to Novalux Psychiatry and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written consent, except for personal, non-commercial use in connection with your own care.
10.
Third-Party Services
Our Services rely on third-party vendors for functions such as payment processing, insurance eligibility verification, e-prescribing, and appointment communications. We are not responsible for the availability, performance, or acts or omissions of these third-party services, though we take reasonable steps to work with vendors who meet applicable healthcare data protection standards.

Disclaimers
THE WEBSITE AND PATIENT PORTAL ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, NOVALUX PSYCHIATRY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
This disclaimer applies to the website and administrative technology only, and does not limit or waive any duty of care owed to you by your treating provider in the provision of clinical services.
12.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOVALUX PSYCHIATRY AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR PATIENT PORTAL, INCLUDING TECHNICAL FAILURES, DELAYS, OR INTERRUPTIONS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR PROFESSIONAL NEGLIGENCE IN THE PROVISION OF CLINICAL CARE, WHICH IS GOVERNED BY APPLICABLE MEDICAL MALPRACTICE AND HEALTHCARE LAW RATHER THAN THESE WEBSITE TERMS.
13.
Indemnification
You agree to indemnify and hold harmless Novalux Psychiatry from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or violation of any applicable law.
14.
Termination
We may suspend or terminate your access to the website or patient portal at any time, with or without notice, for conduct that violates these Terms, poses a security risk, or is otherwise harmful to us or other patients. Termination of portal access does not affect our obligations under HIPAA regarding your existing medical record, nor your right to request a copy of it.
15.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. The “Last Updated” date above reflects the most recent revision.
16.
Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law (including HIPAA).
